How to Get Your License Back After a DWI in New Jersey

Losing your driver's license after a DWI conviction changes your daily life immediately. You cannot drive to work, pick up your children, or handle basic errands. In New Jersey, there are no hardship licenses or restricted permits for DWI suspensions.

License Suspension Periods by Offense

New Jersey's DWI license suspension rules changed significantly with the December 2019 law reform. The current framework relies heavily on ignition interlock devices rather than pure suspension periods.

First Offense

  • BAC 0.08% to 0.09%: License suspended until you install an ignition interlock device. Interlock required for 3 months after restoration.
  • BAC 0.10% or higher: License suspended until interlock installed. Interlock required for 7 to 12 months after restoration.

Second Offense

  • License revoked for 1 to 2 years after completion of interlock period
  • Interlock required for 2 to 4 years after license restoration

Third Offense

  • License revoked for 8 years
  • Interlock required after restoration

Steps to Restore Your License

Getting your license back requires completing every step in the correct order. Missing one step can delay your restoration by months.

Step 1 — Complete All Court Requirements

Before you can begin the restoration process, you must satisfy every court-ordered requirement:

  • Pay all fines and court fees in full
  • Complete your IDRC (Intoxicated Driver Resource Center) program
  • Serve any jail time or community service
  • Complete any court-ordered alcohol treatment programs

Step 2 — Pay the MVC Surcharge

New Jersey imposes an annual insurance surcharge of $1,000 ($1,500 for third offenses) for three years. This is billed by the Motor Vehicle Commission, not the court. You must either pay the full amount upfront or be current on your payment plan before restoration.

If you fall behind on surcharge payments after restoration, your license will be suspended again.

Step 3 — Install the Ignition Interlock Device

Under current law, most DWI offenders must install an approved ignition interlock device before their license can be restored. The device must be installed by a state-approved vendor on every vehicle you own, lease, or operate.

The interlock requires you to blow into a handheld unit before starting your car. If alcohol is detected, the car will not start. The device also requires random retests while driving.

Approved interlock vendors in New Jersey include Draeger, Smart Start, and Intoxalock. Installation costs $100 to $200. Monthly monitoring and calibration fees run $50 to $100.

Step 4 — Obtain SR-22 Insurance

New Jersey requires proof of financial responsibility after a DWI conviction. Your insurance company must file an SR-22 certificate with the MVC confirming you carry the minimum required coverage.

Not all insurance companies provide SR-22 coverage. You may need to switch carriers or obtain a separate policy. Expect significantly higher premiums.

Step 5 — Visit the MVC

Once all requirements are met, visit a New Jersey Motor Vehicle Commission agency to apply for license restoration. Bring:

  • Proof of interlock installation
  • SR-22 insurance certificate
  • Receipts showing fines and surcharges are paid
  • IDRC completion certificate
  • Court order or documentation of your suspension period

The MVC charges a restoration fee of $100.

Life During Suspension

New Jersey does not offer restricted licenses, work permits, or hardship exemptions for DWI-related suspensions. During your suspension period, you cannot legally drive for any reason.

Do not drive on a suspended license. Getting caught driving while suspended for a DWI carries additional mandatory penalties under N.J.S.A. 39:3-40:

  • First offense: $500 fine and 1 to 2 days additional jail time
  • Second offense: $750 fine, 1 to 5 days jail, and additional 1 to 2 year suspension
  • Third offense: $1,000 fine, 10 days jail, and additional 10-year suspension

These penalties are in addition to your existing DWI penalties. A driving-while-suspended charge can turn a manageable situation into a devastating one.

Options During Suspension

While you cannot drive, you can take steps to manage daily life:

  • Public transportation: NJ Transit bus and rail services cover much of the state
  • Rideshare services: Uber and Lyft operate throughout New Jersey
  • Carpooling: Arrangements with coworkers, friends, or family
  • Bicycle or walking: For shorter distances

Plan your transportation before your suspension begins. The adjustment is easier when you have a system in place.

Can You Get Your License Back Early?

Under the current law, early restoration is generally not available for DWI suspensions. The suspension period is the suspension period.

However, the shift toward interlock-based penalties means that many first offenders can have their license restored relatively quickly — as soon as the interlock is installed on their vehicle. The key is completing all prerequisites promptly.
