New Jersey DWI Law: What You Need to Know
New Jersey handles drunk driving under N.J.S.A. 39:4-50, which makes it unlawful to operate a motor vehicle while under the influence of alcohol or drugs. Unlike most states, New Jersey treats DWI as a traffic offense rather than a criminal charge. That means your case will be heard in municipal court, not superior court.

Blood Alcohol Concentration (BAC) Limits
- 0.08% or higher — Standard legal limit for drivers 21 and older
- 0.04% or higher — Commercial vehicle operators

You can also be charged with DWI even if your BAC is below 0.08% if the officer believes your ability to drive was impaired.

- Up to 30 days in jail
- License suspension of 4 to 6 months
- IID installation for 7 to 12 months after license restoration
- IDRC program (12 to 48 hours)
- Insurance surcharges of $1,000/year for 3 years
Second Offense
- Fines totaling approximately $2,000+
- Jail time of 2 to 90 days (48 hours mandatory)
- License suspension of 1 to 2 years
- IID for 2 to 4 years after restoration
- 30 days community service
- Insurance surcharges of $1,000/year for 3 years
Third and Subsequent Offenses
- Fines of $1,000+
- 180 days in jail (mandatory)
- License suspension of 8 years
- IID for 2 to 4 years after restoration
- Insurance surcharges of $1,500/year for 3 years

What to Do After a DWI Arrest in New Jersey
