Speeding ticket or traffic violation in NJ? Papa Alpha & Alpha Law Firm fights to keep points off your record. Free consultation — call (201) 555-0100.

A traffic ticket might seem like a minor inconvenience. Pay the fine and move on. But in New Jersey, that approach can cost you far more than the ticket itself. Points on your license lead to insurance surcharges that last for years. Accumulate enough points and you face license suspension.

At Papa Alpha & Alpha Law Firm, we represent drivers across Springfield, Ridgefield, and Bergen County in municipal court traffic matters. From speeding tickets to reckless driving charges, we fight to protect your driving record and keep your insurance rates down.

The NJ Points System: Why Every Ticket Matters

New Jersey assigns points to your driving record for moving violations under N.J.S.A. 39:5-30.5. Points accumulate and trigger consequences at specific thresholds.

Common Violations and Point Values

| Violation | Points | |-----------|--------| | Speeding (1-14 mph over limit) | 2 | | Speeding (15-29 mph over limit) | 4 | | Speeding (30+ mph over limit) | 5 | | Reckless driving (N.J.S.A. 39:4-96) | 5 | | Tailgating | 5 | | Failure to stop at a red light | 2 | | Improper passing | 4 | | Driving on a suspended license (N.J.S.A. 39:3-40) | 0 (but carries jail risk) | | Failure to yield to a pedestrian | 2 | | Texting while driving | 0 (fines escalate per offense) |

What Happens When Points Add Up

  • 6 points — NJ MVC surcharge of $150/year for 3 years, plus $25 for each point over 6
  • 12+ points — License suspension
  • Insurance impact — Each point can raise your premiums. A single 4-point violation can increase your rates by 20% or more for three years.

The financial math is clear. Fighting a ticket often costs less than paying it.

Types of Traffic Cases We Handle

Speeding Tickets

Speeding is the most common traffic violation in New Jersey. We challenge radar and lidar calibration records, question officer training certifications, and negotiate for reduced charges where possible. In many municipal courts, a well-prepared defense can get a speeding ticket amended to a zero-point violation.

Reckless Driving (N.J.S.A. 39:4-96)

Reckless driving carries 5 points, fines up to $200 for a first offense, and up to 60 days in jail. It is a serious charge that goes beyond a simple ticket. We treat reckless driving cases with the same attention we give to criminal defense matters.

Careless Driving (N.J.S.A. 39:4-97)

Careless driving is a 2-point violation but often serves as a reduced charge in negotiations. If you are facing a more serious charge, we work to negotiate it down to careless driving to minimize the impact on your record.

Driving on a Suspended License (N.J.S.A. 39:3-40)

This charge carries no points but can result in additional license suspension, fines of $500 or more, and up to 10 days in jail. If your license was suspended and you did not know, we can raise that as a defense.

Red Light and Stop Sign Violations

Red light camera tickets and officer-observed violations are handled differently. Camera tickets do not carry points but do carry fines. Officer-issued tickets carry 2 points. We review the evidence in both types to identify defenses.

Texting and Cell Phone Violations

Under N.J.S.A. 39:4-97.3, using a handheld device while driving carries escalating fines: $200-$400 for a first offense, $400-$600 for a second, and $600-$800 for a third. A third offense can also result in license suspension. No points are assessed, but the fines add up fast.

How We Fight Traffic Tickets in Municipal Court

Most traffic violations in New Jersey are heard in municipal court. Here is our approach:

  1. Review the ticket and evidence. We examine the officer's notes, radar/lidar records, calibration certificates, and any dashcam or body camera footage.
  2. Identify procedural issues. Was the speed detection device properly calibrated? Was the officer trained and certified? Was the traffic stop conducted lawfully?
  3. Negotiate with the prosecutor. In many NJ municipal courts, prosecutors can amend charges to lower-point or zero-point violations. An attorney's presence often opens negotiation options that are not available to unrepresented drivers.
  4. Try the case if needed. If negotiation does not produce an acceptable outcome, we are prepared to argue your case before the judge.

Common Outcomes We Pursue

  • Amended to unsafe driving (N.J.S.A. 39:4-97.2) — Zero points, fine only
  • Amended to obstructing traffic — Zero points
  • Dismissal — When the evidence does not support the charge
  • Reduced points — Amending a high-point charge to a lower-point violation

The Real Cost of Paying a Traffic Ticket

Many drivers just pay the fine without thinking about the long-term costs. Here is what a single 4-point speeding ticket actually costs over time:

  • Fine: $200-$400
  • Court costs: $33
  • MVC surcharge (if you hit 6+ points): $150/year for 3 years = $450
  • Insurance increase: Approximately 20% for 3 years on a typical premium

A $200 ticket can easily become $2,000+ in total costs. Hiring an attorney to fight the ticket or negotiate a reduction almost always saves money in the long run.
