Divorce in New Jersey

New Jersey is a no-fault divorce state. You do not need to prove adultery, cruelty, or abandonment to file for divorce. Under N.J.S.A. 2A:34-2, the most common ground is "irreconcilable differences" that have lasted for at least 6 months.

You can also file based on an 18-month separation period without needing to prove fault.

Types of Divorce Proceedings

Uncontested Divorce — Both spouses agree on all major issues: property division, custody, support, and debt allocation. This is the fastest and least expensive path. We prepare the settlement agreement and guide you through the filing.

Contested Divorce — One or more issues are in dispute. These cases require negotiation, and sometimes trial, to resolve. We represent you in settlement conferences, mediation, and courtroom proceedings.

Mediated Divorce — A neutral mediator helps both spouses reach agreement. We can serve as your attorney during mediation, advising you on your rights and reviewing any proposed agreement before you sign.

Property Division: Equitable Distribution

New Jersey follows equitable distribution under N.J.S.A. 2A:34-23.1. This does not mean assets are split 50/50. The court considers factors including:

  • Duration of the marriage
  • Age and health of each spouse
  • Income and earning capacity of each spouse
  • Contributions to marital property (including homemaking)
  • Standard of living established during the marriage
  • Tax consequences of the proposed distribution
  • Any prenuptial or postnuptial agreements

We work to identify all marital assets, including retirement accounts, business interests, real estate, and investments, and advocate for a fair division based on your contributions and needs.


Child Custody in New Jersey

NJ courts decide custody based on the best interests of the child under N.J.S.A. 9:2-4. The court considers:

  • The safety of the child
  • The parents' ability to agree and cooperate
  • Each parent's relationship with the child
  • The child's needs and the stability of the home environment
  • History of domestic violence
  • The child's preference (if the child is old enough and mature enough)

Types of Custody

Legal custody — The right to make major decisions about your child's education, health, and welfare. Joint legal custody is common in NJ.

Physical custody — Where the child lives. One parent may have primary physical custody with the other having parenting time, or parents may share custody more equally.

Parenting time (visitation) — The schedule for the non-custodial parent. NJ courts favor maximizing each parent's time with the child unless safety is a concern.

Child Support

New Jersey calculates child support using the NJ Child Support Guidelines, a formula based on both parents' incomes, the number of overnights each parent has, and certain expenses (healthcare, childcare, etc.).

Under N.J.S.A. 2A:34-23, the court can deviate from the guidelines when the circumstances require it. Factors for deviation include:

  • Special needs of the child
  • Private school tuition
  • Extraordinary medical expenses
  • Travel costs for parenting time
  • Income above the guidelines cap

Child support in NJ typically continues until the child is emancipated, which usually occurs at age 19 but can extend for college or other circumstances. There is no automatic termination at 18.

We calculate your expected support obligation (or entitlement) using the guidelines and advocate for adjustments when the standard calculation does not reflect your family's reality.


Alimony in New Jersey

New Jersey reformed its alimony laws in 2014 under N.J.S.A. 2A:34-23. The law now defines four types of alimony:

Open durational alimony — For marriages of 20 years or longer. Has no fixed end date but is subject to modification based on changed circumstances. Replaced the old "permanent alimony."

Limited duration alimony — For marriages under 20 years. Duration cannot exceed the length of the marriage except in exceptional circumstances.

Rehabilitative alimony — Short-term support to help a spouse become self-supporting through education or training.

Reimbursement alimony — Compensates a spouse who supported the other through education or career development with the expectation of sharing in the increased earning potential.

The court considers factors including the length of the marriage, each spouse's earning capacity, the standard of living, the age and health of both parties, and parental responsibilities.

Prenuptial and Postnuptial Agreements

A prenuptial agreement is a contract entered before marriage that specifies how assets, debts, and support will be handled in the event of divorce. Under the Uniform Premarital and Pre-Civil Union Agreement Act (N.J.S.A. 37:2-31 et seq.), a valid prenup in NJ must be:

  • In writing and signed by both parties
  • Executed voluntarily (no duress or coercion)
  • Based on fair disclosure of assets
  • Not unconscionable at the time of enforcement

Postnuptial agreements follow similar principles but are entered during the marriage.

Domestic Violence and Restraining Orders

If you are experiencing domestic violence, your safety is the priority. Under the Prevention of Domestic Violence Act (N.J.S.A. 2C:25-17 et seq.), you can obtain a temporary restraining order (TRO) that provides immediate protection. Within 10 days, the court holds a hearing on whether to issue a final restraining order (FRO).
