Why You Need an Estate Plan

If you die without a will in New Jersey, your estate is distributed according to the intestate succession laws under N.J.S.A. 3B:5-3 et seq. The court decides who gets what based on a statutory formula. Your spouse, children, parents, and siblings receive shares in a prescribed order.

This means:

  • Your partner may not inherit what you intended
  • Distant relatives you barely know could receive assets
  • Your minor children's guardian is chosen by a judge, not by you
  • Your estate may go through a lengthy and expensive probate process
  • Family disputes become more likely without clear instructions

Estate Planning Documents We Prepare

Last Will and Testament

Your will is the foundation of your estate plan. It specifies:

  • Who inherits your property and assets
  • Who serves as executor to manage your estate
  • Who becomes guardian of your minor children
  • How debts and taxes are paid

Under N.J.S.A. 3B:3-2, a valid NJ will must be in writing, signed by you, and witnessed by at least two people. We draft wills that are clear, legally sound, and tailored to your specific family situation.

Revocable Living Trusts

A revocable living trust allows you to transfer assets into the trust during your lifetime while maintaining full control. When you pass away, the trust assets transfer to your beneficiaries without going through probate.

Benefits of a living trust include:

  • Avoids probate — Faster and less expensive distribution of assets
  • Privacy — Unlike a will, a trust is not a public document
  • Incapacity planning — If you become unable to manage your affairs, your successor trustee takes over without court intervention
  • Flexibility — You can modify or revoke the trust at any time during your lifetime

A trust is not right for everyone. We evaluate your specific situation and recommend a trust only when it genuinely benefits you.

Powers of Attorney

A power of attorney (POA) authorizes someone you trust to act on your behalf if you cannot act for yourself.

Financial Power of Attorney — Allows your agent to manage bank accounts, pay bills, handle investments, and conduct financial transactions on your behalf. Under N.J.S.A. 46:2B-8.1 et seq., a durable POA remains effective even if you become incapacitated.

Healthcare Power of Attorney (Healthcare Proxy) — Designates someone to make medical decisions for you if you cannot communicate your wishes. This is separate from a living will and covers situations your living will may not anticipate.

Without these documents, your family may need to petition a court for guardianship or conservatorship. That process is expensive, time-consuming, and public.

Advance Healthcare Directives (Living Will)

An advance directive under the NJ Advance Directives for Health Care Act (N.J.S.A. 26:2H-53 et seq.) documents your wishes regarding medical treatment if you are terminally ill or permanently unconscious. It covers decisions about:

  • Life-sustaining treatment
  • Artificial nutrition and hydration
  • Pain management preferences
  • Organ donation

Your advance directive works alongside your healthcare proxy to ensure your medical wishes are followed even when you cannot speak for yourself.

Beneficiary Designations and Asset Titling

Many assets pass outside your will entirely. Life insurance, retirement accounts, bank accounts with payable-on-death designations, and jointly held property all transfer based on beneficiary designations or titling, not your will.

We review all of your assets to make sure your beneficiary designations align with your overall estate plan. Outdated beneficiary forms are one of the most common estate planning mistakes.


Probate in New Jersey

When someone dies, their will must be submitted to the Surrogate's Court in the county where they lived. The executor named in the will applies for Letters Testamentary to gain authority to manage the estate.

If there is no will, the court appoints an administrator and issues Letters of Administration under N.J.S.A. 3B:10-1 et seq.

The probate process involves:

  1. Filing the will with the Surrogate's Court
  2. Notifying beneficiaries and creditors
  3. Inventorying and appraising assets
  4. Paying debts, taxes, and expenses
  5. Distributing remaining assets to beneficiaries

A well-drafted estate plan simplifies every step of this process. We also represent executors and administrators who need guidance through probate.


New Jersey Estate Tax Considerations

New Jersey eliminated its estate tax for deaths occurring after January 1, 2018. However, NJ still imposes an inheritance tax under N.J.S.A. 54:34-1 et seq. on transfers to certain beneficiaries.

  • Class A beneficiaries (spouse, children, grandchildren, parents) — Exempt
  • Class C beneficiaries (siblings, son/daughter-in-law) — Taxed at 11-16% on amounts over $25,000
  • Class D beneficiaries (everyone else) — Taxed at 15-16% on amounts over $500

Federal estate tax applies to estates exceeding the federal exemption amount (currently $13.61 million per individual). For most families, the NJ inheritance tax is the more immediate concern.
