Rideshare companies classify their drivers' activity into three periods. The insurance coverage available to you changes depending on which period the driver was in at the time of the accident.

Period 1: App On, No Ride Request Accepted

The driver has the Uber or Lyft app turned on and is waiting for a ride request. During this period, the driver's personal auto insurance is primary. Uber and Lyft provide contingent liability coverage:

  • $50,000 per person for bodily injury
  • $100,000 per accident for bodily injury
  • $25,000 for property damage

This coverage applies only if the driver's personal policy does not cover the accident.

Period 2: Ride Request Accepted, En Route to Pickup

The driver has accepted a ride request and is driving to pick up the passenger. Both Uber and Lyft provide at least $1 million in liability coverage during this period. Uninsured/underinsured motorist coverage also applies.

Period 3: Passenger in the Vehicle

The passenger is in the car and the trip is active. This is when the highest coverage applies:

  • $1 million in third-party liability coverage
  • $1 million in uninsured/underinsured motorist coverage
  • Contingent comprehensive and collision coverage for the vehicle

Who Can You Sue After a Rideshare Accident?

Depending on the circumstances, you may have claims against:

The rideshare driver. If the Uber or Lyft driver caused the accident through negligence, they are personally liable. Their personal auto insurance and the rideshare company's insurance may both be in play.
