How New Jersey No-Fault Insurance Works
New Jersey operates under a no-fault auto insurance system. That means your own insurance company pays your medical bills after an accident, regardless of who caused the crash. This coverage is called Personal Injury Protection (PIP).
Under N.J.S.A. 39:6A-4, every auto insurance policy in New Jersey must include PIP coverage of at least $15,000. PIP covers medical expenses, lost wages, and essential services you cannot perform while recovering.
But PIP has limits. If your injuries exceed your policy coverage, or if you suffer permanent damage, you may have the right to step outside the no-fault system and file a claim against the at-fault driver.
The Verbal Threshold and Your Right to Sue
When you purchased auto insurance, you chose one of two options: the limitation on lawsuit threshold (verbal threshold) or the no limitation on lawsuit threshold (zero threshold).
If you selected the verbal threshold, you can only sue the at-fault driver if your injuries meet certain criteria under N.J.S.A. 39:6A-8. Qualifying injuries include:
- Loss of a body part
- Significant disfigurement or scarring
- A displaced fracture
- Loss of a fetus
- Permanent injury within a reasonable degree of medical probability
- Death
